[CED/CD/EAT] New Encouraged Practice: Meal and Rest Period Breaks

EC, Shared Governance Chairs, CEDs, Academic Unit Heads, and AES Leaders,

The UA does not have a policy for rest and meal breaks and instead grants authority to each department head (Classified Staff Handbook<http://policy.arizona.edu/employmenthuman-resources/meal-periods-and-rest-periods-breaks>; UHAP<http://policy.arizona.edu/employment-human-resources/fair-labor-standards-act-and-overtime-policy>).  Following is an encouraged practice for the treatment of rest and meal breaks for ALVSCE employees.  It has been reviewed by the Executive Council and is shared in the spirit of consistent and fair treatment, and to live up to the division's Foundational Goal to be the most sought after place to be a part of.

Please ensure that those with supervisory responsibilities within your unit are familiar with university guidance and with our encouraged practice for meal and rest periods (breaks).

Meal and Rest Periods (Breaks) in ALVSCE

Encouraged Practice
Meal Periods
All employees are authorized to take one unpaid meal period of at least 30 minutes during each 8-hour workday.  Unit heads can establish longer meal periods than this minimum.

Break Periods
All employees are authorized to take a paid rest period of up to 15 minutes each during a four-hour work period.  Since rest periods are paid time, each is considered time worked for the purpose of reporting work hours on the Employee Time Record.

Employees may not use break periods (1) to offset late arrival or early departure from the worksite, (2) to extend the meal period, or (3) to accumulate paid time off from one day to the next.

If you're not familiar with, or just need a refresher on FLSA, overtime, comp time, exempt vs. non-exempt employees, and the UA policies around these items, we STRONGLY ENCOURAGE you and your reports attend one of the upcoming FLSA Trainings we're going to be delivering in the coming weeks!
